The Senate met at 11:18 a.m. and was called to order by the President.

SENATOR ANNOUNCED PRESENT

Senator Hinojosa, who had previously been recorded as "Absent-excused," was announced "Present."

Dr. Charles R. Wade, Executive Director, Baptist General Convention of Texas, offered the invocation as follows:

Our Father, You are in heaven, but we are not yet. So in the meanwhile, may we be like trees planted by streams of water which give fruit in season and whose leaves, even, do not whither away. For that to be so, the psalmist reminds us, we must not walk in the counsel of the wicked or sit in the seat of mockers. We find genuine delight in doing the will of God, and we give careful thought to the way that is Your way. We give thanks today for the life of a man who lived among us like that. He lent the weight of his powerful convictions and integrity to move debate and decision-making forward. He helped us all to do right and give a care for the least among us by the force of the facts, common sense, and ethical values which he pressed upon us. You know, O Lord, that Phil Strickland prayed for these men and women. And he not only prayed they would have both divine wisdom and moral courage, he prayed for their families, for their well-being, and for their faith. O Lord, bless them in their work this day and every day. We end our prayer with the words of Jesus: "Let Your will be done on Earth as it is done in heaven," which surely must mean at the very least that we will use the power and influence of our lives to bless and teach all the children of Texas. In His name, I pray. Amen.

PHYSICIAN OF THE DAY

Senator Shapiro was recognized and presented Dr. Christopher Lawrence of McKinney as the Physician of the Day.

The Senate welcomed Dr. Lawrence and thanked him for his participation in the Physician of the Day program sponsored by the Texas Academy of Family Physicians.

SENATE RESOLUTION 85

Senator Lucio offered the following resolution:

WHEREAS, The Senate of the State of Texas is pleased to recognize the Shaken Baby Alliance for its outstanding work in calling attention to the particular form of abusive head trauma known as Shaken Baby Syndrome and to join the alliance in promoting April as Child Abuse Prevention Month; and

WHEREAS, Head trauma is a leading cause of death and disability among infants and children; Shaken Baby Syndrome occurs when a caregiver violently shakes or slams a child, usually to stop the child from crying; and

WHEREAS, Shaken Baby Syndrome often causes permanent, irreparable brain damage or death to an infant; the whiplash motion caused by violent shaking results in the tearing and bleeding of delicate veins, causing pressure that destroys brain tissue; and

WHEREAS, Estimates show that as many as 50 percent of teenage and adult caregivers do not know that shaking a baby is dangerous and can be fatal; it is the aim of the Shaken Baby Alliance to share this vital information with everyone who cares for children; and

WHEREAS, The threefold mission of the Shaken Baby Alliance consists of support for victims' families, prevention of Shaken Baby Syndrome through education, and justice for the innocent victims; and

WHEREAS, The most effective solution for ending Shaken Baby Syndrome is prevention, and Child Abuse Prevention Month offers the opportunity to educate the public regarding the dangers of this serious problem; now, therefore, be it

RESOLVED, That the Senate of the State of Texas, 79th Legislature, 3rd Called Session, hereby commend the Shaken Baby Alliance during Child Abuse Prevention Month for its exceptional efforts to stop Shaken Baby Syndrome and extend best wishes to members of the alliance for success in the fight against Shaken Baby Syndrome; and, be it further

RESOLVED, That a copy of this Resolution be prepared for the alliance as an expression of esteem from the Texas Senate.

SENATE RESOLUTION 71

Senator Hinojosa offered the following resolution:

WHEREAS, The Senate of the State of Texas takes pride in recognizing the organizers of the 47th Annual League of United Latin American Citizens Council Number One Feria de las Flores and the Feria's participants on the occasion of their visit to the State Capitol on April 27, 2006; and

WHEREAS, This is the 47th year that the Council Number One has sponsored the Feria de las Flores; the council is noted for its efforts to raise money for scholarships for qualified college-bound students; through the generosity of South Texas businesses, the council has given more than $1 million in scholarship money to the winners of the Feria; and

WHEREAS, The Feria de las Flores is a celebration of the heritage of Mexican American citizens and includes dance, music, and dress typical of the different regions south of the border; the participants compete in the categories of dance routine, costume, poise, personality, beauty, and on-stage questioning; and

WHEREAS, The first Feria de las Flores was created and organized by Joe Flores in 1959, and Abby Piña was crowned the first Feria de las Flores Queen; this year the contestants are Jacqueline Castellanos, Lisa Marie Castillo, Mirna Flores, Imelda Perales, Amber Vasquez, and Amy Velasquez; the 2005 Feria de las Flores Queen is Teresa Sanchez; and

WHEREAS, Council Number One's Feria de las Flores is an exemplary competition that provides educational opportunities for the young people of South Texas; now, therefore, be it

RESOLVED, That the Senate of the State of Texas, 79th Legislature, 3rd Called Session, hereby commend the League of United Latin American Citizens Council Number One on its humanitarian endeavors and extend a warm welcome to the participants and organizers of the 47th Annual Feria de las Flores; and, be it further

WHEREAS, The Texas Senate takes great pride in joining the Texas Association of Counties in recognizing April 26, 2006, as County Government Day at the State Capitol; and

WHEREAS, The week of April 23-29, 2006, is being observed by the National Association of Counties as National County Government Week to provide the nation's citizens with an opportunity to honor the many contributions made by county governments; and

WHEREAS, The oldest form of local government in the United States, county government addresses many critical issues, including environmental protection, indigent health care, special assistance for the elderly, job training, and public safety; and

WHEREAS, The dedicated individuals who serve our state's 254 counties as elected or appointed officials not only work diligently to meet the needs of citizens without placing an undue burden on taxpayers but also commit themselves to finding solutions to problems that will benefit all Texans; and

In Memory

of

Phil Strickland

Senate Resolution 65

WHEREAS, The Senate of the State of Texas honors and commemorates the life of Phil Strickland, who died February 11, 2006, at the age of 64; and

WHEREAS, Born October 17, 1941, Phil Strickland grew up in Abilene; he graduated from The University of Texas at Austin and The University of Texas School of Law and also studied at Southwestern Baptist Theological Seminary; and

WHEREAS, Phil was a strong advocate for the historic Baptist traditions of religious liberty and separation of church and state; he believed his responsibilities as a leader included speaking to fellow Texas Baptists about the issues of applied Christianity, such as poverty, racism, and the environment; and

WHEREAS, Phil served on the Christian Life Commission of the Baptist General Convention of Texas for 38 years; he was the state's first registered lobbyist for a religious denomination and was a legendary champion of children and the poor; and

WHEREAS, A man of deep faith and compassion, Phil spoke with courage and grace on behalf of the less fortunate in our society, and his wisdom, warmth, and valued counsel will not be forgotten by those who knew him; and

WHEREAS, A devoted husband, father, and grandfather, he leaves behind memories that will be cherished forever by his family and countless friends; now, therefore, be it

RESOLVED, That the Senate of the State of Texas, 79th Legislature, 3rd Called Session, hereby extend sincere condolences to the bereaved family of Phil Strickland: his wife, Carolyn; his daughters, Delaine Mueller and Shannon Holman; his mother, Sybil Strickland; and his four grandchildren; and, be it further

RESOLVED, That a copy of this Resolution be prepared for the members of his family as an expression of deepest sympathy from the Texas Senate, and that when the Senate adjourns this day, it do so in memory of Phil Strickland.
