The Senate met at 10:00 a.m. pursuant to adjournment and was called to order by the President.

Heavenly Father, we give You thanks for protecting us through the night from all danger and harm and bringing us safely to this new day. Preserve and strengthen us this day for the work You have called us to do. Keep our thoughts pure, our intentions true, our words kind, and our actions loving.

Pour out Your spirit upon these Senators and all the leaders of the State of Texas, that they might accomplish great things in this session. As they go about their important work keep the needs of our weaker brothers and sisters ever in their thoughts: the sick, the lonely, the forgotten, the unemployed, victims of violence, the homeless, the hungry, the chemically dependent. And especially in this month of April, we remember the victims of sexual assault. May these Senators be a voice for those who have no voice, that the work they do here will alleviate suffering, preserve Your creation, and bless all the people of Texas.

And as we are strangers and pilgrims on this Earth, help us to prepare for the world to come, keeping our minds and hearts focused on things eternal. Let Your holy angels watch over us and the wicked one have no power over us. To You be honor, praise, and glory forever and ever. Amen.

SENATE RESOLUTION 618

Senator Barrientos offered the following resolution:

WHEREAS, The Senate of the State of Texas takes pride in welcoming Kandace Krueger, Miss USA, who is coming to the State Capitol on April 3, 2001; and

WHEREAS, Kandace represented Austin when she competed for and won the title of Miss Texas USA on July 17, 2000, in Lubbock, Texas; on March 2, 2001, she competed against delegates from 49 other states and the District of Columbia to become Miss USA; and

WHEREAS, In the 50-year history of the Miss USA Pageant, a young woman from Texas has captured the winning spot eight times when no other state has had more than five winners in that time; on May 11, 2001, Miss Krueger will represent the United States at the Miss Universe Pageant which will be televised from Puerto Rico; and

WHEREAS, Graceful and poised, Miss Krueger is five feet, 11 inches tall with blonde hair and green eyes; she is a senior journalism major at Texas A&M University; and

WHEREAS, Calling herself a sports fanatic, Miss USA is a big fan of the Texas Rangers, the Dallas Cowboys, and Texas A&M University; Kandace plans to become a sports broadcaster after graduation; and

Senator Lindsay offered the following resolution:

WHEREAS, Members of the Houston chapter of the American Leadership Forum are visiting the Capitol on April 3, 2001, and it is a pleasure to extend a welcome to these public-spirited individuals; and

WHEREAS, Founded in 1980 by lawyer Joseph Jaworski and 17 other prominent Americans, the forum seeks to identify leaders in communities across the country, develop their leadership skills, and encourage them to join together in addressing public issues; and

WHEREAS, Every year approximately 20 established leaders in each chapter are selected to participate in an intensive, year-long program in which they explore the nature of leadership and nurture a variety of leadership skills; the makeup of each class is intended to reflect the demographic profile of the community, as well as to include the perspectives of business, religious, and academic leaders and elected officials; and

WHEREAS, The work of the American Leadership Forum is premised on the belief that the responsibility for improving organizations, communities, and society as

SENATE BILL 324 ON SECOND READING

On motion of Senator Brown and by unanimous consent, the regular order of business was suspended to take up for consideration at this time on its second reading and passage to engrossment:

SB 324, Relating to fees charged for underground injection wells.

The bill was read second time.

Senator Brown offered the following amendment to the bill:

Floor Amendment No. 1

Amend SB 324 by striking all below the enacting clause and substituting the following:

SECTION 1.  Section 27.014, Water Code, is amended to read as follows:

Sec. 27.014.  APPLICATIONS [APPLICATION FEE ]. With each application for a disposal well permit, the commission shall collect a fee in the amount provided in and under the terms of Section 5.235. The application for a hazardous or nonhazardous disposal well permit shall be processed in accordance with this chapter [of $25 ] for the benefit of the state and the preservation of its natural resources.

SECTION 2.  The changes in law made by this Act regarding the decisions by the Texas Natural Resource Conservation Commission apply to all applications for injection wells pending on or submitted on or after the effective date of this Act.

SECTION 3.  This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2001.

The amendment was read and was adopted by a viva voce vote.

Senator Gallegos offered the following resolution:

WHEREAS, On this day, students involved in the Empowering Teen Leaders and Community Teen Leaders programs in Harris County high schools have come to the State Capitol to meet with state leaders and experience the legislative process firsthand; and

WHEREAS, Established by the Texas Agricultural Extension Service, the teen leader programs help to instill in youth the knowledge and skills essential for success; through their involvement, the high school juniors present today have demonstrated great initiative and maturity, as well as a commitment to the betterment of their community through volunteerism; and

WHEREAS, Becoming role models for their peers, these student leaders join a select group of students who have received this training before them, 36 of whom have been presented with the Presidential Youth Service Gold Award from the president of the United States for their outstanding community service; and

WHEREAS, All told, Empowering Teen Leaders and Community Teen Leaders have touched the lives of more than 93,000 people and contributed over 41,000 hours of civic service, and these Harris County students are adding greatly to the programs' impressive record of achievement; now, therefore, be it

RESOLVED, That the Senate of the State of Texas, 77th Legislature, hereby commend the members of the Empowering Teen Leaders and Community Teen Leaders programs for their exceptional volunteer efforts and extend to them best wishes for an educational and memorable visit to the seat of Texas government.
