Heavenly Father, we humbly come before You today and acknowledge that You are God, and we are not. You are the creator of all, You are sovereign over all, and You are the redeemer for all who trust in the finished work of Your son, Jesus Christ. Father, we thank You for allowing us to live in this great nation and we thank You for all of those who have served and who currently are serving in our Armed Forces. We pray for Your continued blessing and protection on them and over them. Father, we also thank You for the privilege that we have to live in the great State of Texas, and we thank You for those in this room today who serve our state in their elected positions. I pray specifically for them today that You would give them the wisdom, discernment, and courage they need to make the best decisions that are set before them. I pray that You would help them to always remember that they are not only accountable to those that they represent, but most importantly, they are accountable to You for the choices and decisions they make. I pray that in light of this reality, they would faithfully and diligently fulfill their roles and responsibilities to the best of their abilities. Lord, I pray that Your hand of blessing and protection would be upon them, and I pray that they would not just seek to be leaders who serve, but more importantly, help them to strive to be servants who lead for the good of the people and for the glory of Your name. And I pray all of these things in the name that is above all names, the name of Jesus Christ. Amen.

CONFERENCE COMMITTEE ON SENATE BILL 293
Senator Huffman moved that the Senate respectfully request that the House take up for consideration the Senate's request to recede from a House amendment and concur in the alternative Senate amendment to SB 293 as presented in SR 695.
Senator Huffman further moved that the Senate ask for a conference on the pending matters of disagreement on SB 293 if the House chooses to not act upon the Senate's request pursuant to SR 695; and that the President be authorized to appoint conferees on the part of the Senate.
The motions prevailed.
The President asked if there were any motions to instruct the conference committee on SB 293 before appointment.
Senator West moved to instruct the conference committee to not consider any non-germane amendments.

BE IT RESOLVED by the Senate of the State of Texas, 89th Legislature, Regular Session, 2025, That Senate Rule 12.03 be suspended in part as provided by Senate Rule 12.08 to enable the conference committee appointed to resolve the differences on House Bill 46 (the medical use of low-THC cannabis under and the administration of the Texas Compassionate-Use Program; requiring registration) to consider and take action on the following matter:
Senate Rule 12.03(4) is suspended to permit the committee to add text on a matter not included in either the house or senate version of the bill in proposed SECTION 15 of the bill, by adding Section 169.003(c), Occupations Code, to read as follows:
(c) A physician may prescribe more than one package in a 90-day period.
Explanation: The change is necessary to clarify that a physician may prescribe more than one package of low-THC cannabis to a patient in a 90-day period.

The President laid before the Senate the following resolution:
WHEREAS, The Texas Legislative Medal of Honor was established to recognize gallant and intrepid service by a member of the state or federal military forces, and it is fitting that U.S. Army veteran Rickey Dudley Wittner be awarded this prestigious honor; and
WHEREAS, A native of Houston, Rickey Wittner enlisted in the U.S. Army in August 1969 and underwent helicopter training at Fort Eustis, Virginia, before beginning his service in the Vietnam War with the U.S. Army 242nd Assault Support Helicopter Company, 269th Aviation Battalion; and
WHEREAS, On July 10, 1970, Specialist Fourth Class Wittner was serving as crew chief on a helicopter that was resupplying river patrol boats near Dau Tieng, Vietnam; the aircraft was struck by heavy enemy fire, and the subsequent crash and explosion seriously injured all passengers on board, with Specialist Wittner being thrown from the helicopter; without regard for his own safety, he repeatedly entered the flaming wreckage to rescue those trapped inside; demonstrating remarkable bravery, he sustained severe burns on his hands while extinguishing flames on the clothing of those he rescued, and his efforts ultimately helped save the lives of 12 people; and
WHEREAS, In recognition of his actions that day, Specialist Wittner was awarded the Soldier's Medal for heroism; he also received the Purple Heart and the Air Medal; following the completion of his active-duty army service in 1975 at the rank of Specialist Fifth Class, he joined the U.S. Army Reserve, transferring to the Texas Army National Guard headquarters company in Marshall as a member of the 5th Battalion, 112th Armor; in 1987, he was honorably discharged at the rank of sergeant; and
WHEREAS, Rickey Wittner distinguished himself through his acts of extraordinary courage, patriotism, and selflessness in the Vietnam War, and it is indeed fitting that he be honored with the highest military award conferred by the State of Texas; now, therefore, be it
RESOLVED, That the 89th Legislature of the State of Texas hereby direct the governor of the State of Texas to award the Texas Legislative Medal of Honor to U.S. Army veteran Rickey Dudley Wittner in recognition of his valiant military service.

The Presiding Officer laid before the Senate the following resolution:
WHEREAS, The Texas Legislative Medal of Honor was established to recognize gallant and intrepid service by a member of the state or federal military forces, and it is fitting that U.S. Navy SEAL Nathan Gage Ingram of Roanoke be posthumously recognized with this prestigious honor; and
WHEREAS, Born on March 22, 1996, Gage Ingram was a graduate of Byron Nelson High School in Trophy Club and Texas Tech University; he answered his nation's call to duty by enlisting in the United States Navy in 2019; after completing SEAL qualification training, he joined one of the most elite fighting forces in the world and attained the rank of Special Warfare Operator Petty Officer 2nd Class; and
WHEREAS, On January 11, 2024, Petty Officer Ingram and the other members of SEAL Team 3 were tasked with carrying out a raid on a cargo ship carrying Iranian missile components bound for Houthi militants in Yemen; he was serving as team lead communicator during the hazardous nighttime operation that took place in rough seas off the coast of Somalia; while waiting to board the cargo ship, he saw a member of his unit fall into the water; without regard for his own safety, he jumped into the sea to attempt a rescue but was unable to locate his fellow SEAL amid the five- to eight-foot swells; Petty Officer Ingram grabbed hold of a ladder on the target vessel but rather than climbing to safety, he again tried to find his teammate until being swept away by a wave; both men were lost at sea; and
WHEREAS, Petty Officer Ingram was posthumously promoted to Special Warfare Operator First Class, and he has been honored with the Navy and Marine Corps Medal for his extraordinary heroism; he was also the recipient of the Navy "E" Ribbon, the National Defense Service Medal, and the Global War on Terrorism Expeditionary Medal; the 27-year-old Texan left behind a loving family to treasure his memory, including his wife, Jewel Ingram, his mother and stepfather, Kristi and Danny Hughes, his father, Chet Ingram, his sister, Jaci Ingram, and his stepsiblings, Tyler Hughes and Deidra Mytopher; and
WHEREAS, A young man of uncommon courage and patriotism, Nathan Gage Ingram made the ultimate sacrifice in service to his nation, and he is truly deserving of our state's highest military award for valor; now, therefore, be it
RESOLVED, That the 89th Legislature of the State of Texas hereby direct the governor of the State of Texas to posthumously award the Texas Legislative Medal of Honor to U.S. Navy SEAL Nathan Gage Ingram in recognition of his valiant military service.

Senate Rule 12.03(2) is suspended to permit the committee to omit text not in disagreement in proposed SECTION 2 of the bill, by omitting added Section 109.61(a-1)(1)(A)(i), Alcoholic Beverage Code. The omitted text reads:
(i) a package store permit;
Explanation: The change is necessary to require the holder of a package store permit to visually inspect and access electronically readable information on a driver's license, commercial driver's license, or other identification certificate for the purpose of verifying a purchaser's age in the retail sale of an alcoholic beverage on the premises of the package store for off-premises consumption.

WHEREAS, The city of San Antonio shares a proud bond with the military that has spanned more than three centuries, and the city's enduring links to the United States armed forces are central to its culture and economy; and
WHEREAS, Dating back to the establishment of San Antonio de Béxar Presidio in 1718, the city has been home to a consistent military presence; San Antonio's development into an important center for the U.S. service branches dates to the early 1900s, when Fort Sam Houston became a major site for training and operations; today, San Antonio has one of the highest concentrations of military bases in the United States; and
WHEREAS, Joint Base San Antonio, the largest base within the U.S. Department of Defense, is a consolidation of Fort Sam Houston, Camp Bullis, Lackland Air Force Base, and Randolph Air Force Base; serving as a hub for training, innovation, and support, JBSA employs more than 100,000 people and contributes $53.2 billion to the state's economy annually; moreover, Fort Sam Houston includes Brooke Army Medical Center, the DOD's largest medical center and only Level I Trauma Center; and
WHEREAS, With one of the nation's largest active and retired military populations, San Antonio offers a wealth of resources to support this community, including education and job training initiatives and a vast network of health care services; in addition, the city's culture of military appreciation is reflected in the myriad events it hosts in honor of the men and women who serve, including elaborate ceremonies on Veterans Day and Memorial Day and parades and activities during Fiesta San Antonio; moreover, the city features a number of museums and sites that enable visitors to better appreciate the rich history of the military in San Antonio, including the U.S. Army Medical Department Museum and the Fort Sam Houston Museum and Quadrangle; and
WHEREAS, The City of San Antonio has demonstrated tangible support for the military by securing and investing over $115 million in grants for infrastructure, force protection, resiliency, family and veteran employment, and aviation safety; in addition, the city has worked closely with members of the Texas Legislature to advocate for enhanced protection for San Antonio's military installations; and
WHEREAS, Through its steadfast commitment to supporting the U.S. armed forces and the active duty service members and veterans who have carried out its vital mission, San Antonio has long been known as Military City USA, and it is indeed fitting that the city be officially accorded this same title for the State of Texas; now, therefore, be it
RESOLVED, That the 89th Legislature of the State of Texas hereby designate San Antonio as Military City Texas; and, be it further
RESOLVED, That, in accordance with the provisions of Section 391.003(e), Government Code, this designation remain in effect until the 10th anniversary of the date this resolution is finally passed by the legislature.

WHEREAS, A vibrant southeast Texas community, Bridge City has become known as a premier destination for a food that's synonymous with good times and good eating: the corn dog; and
WHEREAS, Bridge City has a rich history of bringing people together through events and festivals that foster a spirit of hospitality and camaraderie; corn dogs are an especially popular food at these gatherings, and attendees line up to procure the sweet-and-savory treat, which is made by coating a hot dog in cornmeal batter, deep-frying it, and serving it on a stick for easy consumption while strolling; and
WHEREAS, The origin of this classic American snack food is a matter of debate, but it has become a signature delicacy in Bridge City; local vendors and food establishments are renowned for their expertise in crafting delicious corn dogs, and they have become beloved enterprises that are frequented by locals and visitors alike; a number of the proprietors operate on a daily basis so that enthusiasts don't have to wait for a special event to enjoy a tasty dog; and
WHEREAS, Whether eaten with ketchup, mustard, or more exotic toppings, the corn dog is an all-American favorite, and it has become an iconic specialty and a source of civic pride for the residents of Bridge City; now, therefore, be it
RESOLVED, That the 89th Legislature of the State of Texas hereby designate Bridge City as the official Corn Dog Capital of Texas; and, be it further
RESOLVED, That, in accordance with the provisions of Section 391.003(e), Government Code, this designation remain in effect until the 10th anniversary of the date this resolution is finally passed by the legislature.

Senator Hughes offered the following resolution:
BE IT RESOLVED by the Senate of the State of Texas, 89th Legislature, Regular Session, 2025, That Senate Rule 12.03 be suspended in part as provided by Senate Rule 12.08 to enable the conference committee appointed to resolve the differences on House Bill 40 (relating to the business court) to consider and take action on the following matters:
(1) Senate Rule 12.03(4) is suspended to permit the committee to add text on a matter not included in either the house or senate version of the bill in proposed SECTION 56 of the bill, adding Section 25A.021, Government Code, to read as follows:
Sec. 25A.021. ACTIONS COMMENCED BEFORE SEPTEMBER 1, 2024. (a) Notwithstanding Section 8, Chapter 380 (H.B. 19), Acts of the 88th Legislature, Regular Session, 2023, a civil action commenced before September 1, 2024, that is within the jurisdiction of the business court may be transferred to and heard by the business court on an agreed motion of a party and permission of the business court under rules adopted by the supreme court for the purpose. When adopting rules under this section, the supreme court shall:
(1) prioritize complex civil actions of longer duration that have proven difficult for a district court to resolve because of the other demands on the district court's caseload;
(2) consider the capacity of the business court to accept the transfer of the action without impairing the business court's efficiency and effectiveness in resolving actions commenced on or after September 1, 2024; and
(3) ensure the facilitation of the fair and efficient administration of justice.
(b) This section expires September 1, 2035.
Explanation: This change is necessary to allow civil actions commenced before September 1, 2024, to be transferred to and heard by the business court on the agreement of the parties and with the permission of the business court.
(2) Senate Rule 12.03(4) is suspended to permit the committee to add text on a matter not included in either the house or senate version of the bill in proposed SECTION 72 of the bill, by adding nonamendatory transition language to read as follows:
SECTION 72. Except as provided by Section 25A.021, Government Code, as added by this Act, the changes in law made by this Act apply only to civil actions commenced on or after September 1, 2024.
Explanation: This change is necessary to allow civil actions commenced before September 1, 2024, to be transferred to and heard by the business court under Section 25A.021, Government Code, as proposed in SECTION 56 of the bill.

Senate Rule 12.03(2) is suspended to permit the committee to omit text not in disagreement in proposed SECTION 4 of the house engrossment of the bill by omitting added Section 225.255, Transportation Code, and the corresponding provision of the bill as the bill was amended by the senate. The omitted text reads:
Sec. 225.255. EDDIE BERNICE JOHNSON MEMORIAL HIGHWAY. (a) The portion of U.S. Highway 67 in Dallas and Ellis Counties between its intersection with U.S. Highway 287 and its intersection with Interstate Highway 20 is designated as the Eddie Bernice Johnson Memorial Highway. The designation is in addition to any other designation.
(b) Subject to Section 225.021(c), the department shall:
(1) design and construct markers indicating the designation as the Eddie Bernice Johnson Memorial Highway and any other appropriate information; and
(2) erect a marker at each end of the highway and at appropriate intermediate sites along the highway.

WHEREAS, The Senate of the State of Texas honors and commemorates the life of Elizabeth Ann Seligman McCarty, who died on November 7, 2024, at the age of 72; and
WHEREAS, A fourth-generation New Mexican, Elizabeth "Betty" Seligman was born in Albuquerque on September 29, 1952; she graduated from Highland High School in 1970, and she went on to earn her nursing degree from the University of New Mexico; and
WHEREAS, Betty began her nursing career at MD Anderson Cancer Hospital in Houston, where she met her adoring husband, Christopher McCarty; after moving to Brenham, she continued her vocation at several area clinics and medical centers; and
WHEREAS, An exemplary citizen and beloved member of her community, Betty devoted more than two decades of service and developed many lasting friendships as the mobile district director for State Senator Lois Kolkhorst and as the Kolkhorst campaign accountant; and
WHEREAS, She raised her children, Thomas Randolph McCarty and Molly McCarty Gonzales, by loving example, and her four grandchildren, Tyler, Madison, Everett, and Rory, enriched her life immeasurably; and
WHEREAS, Above all, Betty McCarty treasured time spent with her family, and she enjoyed taking weekend trips to the casino and was noted for the attentive care she provided to injured wildlife; she inspired her many friends and loved ones through her generosity and her joyful spirit, and she leaves behind memories that will long be cherished by all who were privileged to share in her life; now, therefore, be it

Senate Resolution 719
WHEREAS, The Senate of the State of Texas honors and commemorates the life of Pastor Dave Welch; and
WHEREAS, Pastor Dave Welch was the founder and executive director of the Houston Area Pastor Council, the Texas Pastor Council, and the United States Pastor Council; for four decades, he held leadership positions at notable religious organizations, including roles as founding executive director of the Christian Coalition of Washington, national field director of the Christian Coalition, and executive director of Vision America; and
WHEREAS, The Houston Area Pastor Council was launched under the guidance of Pastor Welch in 2003, and it has grown to involve more than three hundred pastors; it has been used in cities throughout the nation as a model for the grassroots development of interracial, interdenominational teams of pastors who are mutually committed to promoting Biblical principles in the home, the church, and the community through ministry in their local churches; and
WHEREAS, Pastor Welch served at the forefront of interactions between the church and members of government at the city, state, and national levels; many leaders in Texas government, including state senators and the lieutenant governor, worked with Pastor Welch for the better part of two decades, and his commitment to faith, family, and freedom reflected the highest ideals of the Lone Star State; and
WHEREAS, Dave grew up in a patriotic working-class family in the State of Washington; he was ordained by Grace International, and he was a licensed minister with the Church of God in Christ; he and his wife, Valerie, were married for 42 years, and they were blessed with six children and twenty grandchildren, who enriched their lives immeasurably; now, therefore, be it

Fred Joseph Mitchell
Senate Resolution 720
WHEREAS, The passing of Fred Joseph Mitchell of Lewisville on April 21, 2025, at the age of 75, brought an immeasurable loss to his family and friends; and
WHEREAS, The son of Andrew Joe Mitchell and Florence Mayho Mitchell, Fred Mitchell was born in St. James, Louisiana, on January 18, 1950, and he grew up with the company of 10 siblings, Robert, Jimmy, Norman, Katherine, Herbert, Josephine, Charles, Michael, Marion, and Peter; the family moved to Grapevine before he entered school, and the girl next door, the former Bobbie Jo Benson, would become the love of his life; and
WHEREAS, Mr. Mitchell attended schools in Grapevine as well as I. M. Terrell High School in Fort Worth; baptized at St. Francis of Assisi Catholic Church in Grapevine, he was a faithful parishioner and served as an altar boy and usher; he and Bobbie Mitchell were joined in matrimony at the church on October 16, 1971; and
WHEREAS, A devoted couple, Mr. and Mrs. Mitchell were blessed with two children, Darin and Rhonda; their treasured family eventually grew to include two more generations; throughout Mrs. Mitchell's long career as an elected official, Mr. Mitchell was an unwavering source of support and encouragement; and
WHEREAS, Mr. Mitchell was employed over the years by LTV, Engine Components, Home Interiors, Advanced Graphics, and the Lewisville Independent School District; while quiet and unassuming by nature, he was always quick to help others feel better by offering a kind word, a hug, or a little joke; he was an avid fisherman and loved to watch races at the Texas Motor Speedway; and
WHEREAS, Although Fred Mitchell is deeply missed, those who held him dear will forever remember the warmth and generosity he brought into their lives; now, therefore, be it
