Amend SB 58 (senate committee report) as follows:
(1)  In SECTION 1 of the bill, immediately following Section 328.001, Business & Commerce Code (page 1, between lines 43 and 44), insert the following:
Sec. 328.002.  PROHIBITION ON ONLINE SALE OF ASSAULT WEAPONS.(a) In this section, "assault weapon" means:
(1)  a semiautomatic centerfire rifle that has the capacity to accept a detachable magazine that has:
(A)  a pistol grip that protrudes conspicuously beneath the action of the firearm;
(B)  a folding or telescoping stock;
(C)  a thumbhole stock;
(D)  a second handgrip or a protruding grip that can be held by the non-trigger hand;
(E)  a flash suppressor, muzzle break, or muzzle compensator; or
(F)  a grenade launcher or flare launcher;
(2)  a semiautomatic centerfire rifle that has a fixed magazine that holds more than 10 rounds of ammunition;
(3)  a semiautomatic centerfire rifle that has an overall length of less than 30 inches;
(4)  a semiautomatic shotgun that has the capacity to accept a detachable magazine;
(5)  a semiautomatic shotgun that has a folding or telescoping stock and has:
(A)  a thumbhole stock; or
(B)  a second handgrip or a protruding grip that can be held by the non-trigger hand;
(6)  a semiautomatic pistol that has the capacity to accept a detachable magazine and has:
(A)  a second handgrip or a protruding grip that can be held by the non-trigger hand;
(B)  an ammunition magazine that attaches to the pistol outside of the pistol grip;
(C)  a threaded barrel capable of accepting a flash suppressor, forward handgrip, or silencer; or
(D)  a shroud that is attached to or partially or completely encircles the barrel and that permits the shooter to hold the firearm with the non-trigger hand without being burned;
(7)  a semiautomatic pistol that has a fixed magazine that holds more than 10 rounds of ammunition;
(8)  a revolving cylinder shotgun; or
(9)  a conversion kit, part, or combination of parts from which an assault weapon can be assembled or with which a firearm may be converted into a weapon described by Subdivision (1), (2), (3), (4), (5), (6), (7), or (8).
(b)  For purposes of this section, "assault weapon" does not include any rifle, shotgun, or pistol that has been rendered permanently inoperable.
(c)  A person may not sell an assault weapon on an Internet website to a person who is younger than 21 years of age.
(2)  In SECTION 1 of the bill in added Chapter 328, Business & Commerce Code (page 1, line 44), strike "328.002" and substitute "328.003".

Robert Lynn "Skip" Trimble

Senate Resolution 346

WHEREAS, Robert Lynn Trimble, an esteemed attorney and a tireless advocate for animal welfare law in the State of Texas, passed away on June 18, 2022, at the age of 82; and
WHEREAS, Born on January 31, 1940, to Lynn and Faye Fisher Trimble, "Skip" Trimble grew up with the companionship of two sisters, Karen and Linda; he went on to graduate from South Oak Cliff High School in 1957, and after serving in the United States Marine Corps, he earned his undergraduate degree from Southern Methodist University in 1961 and his law degree from SMU's law school in 1964; he moved to Washington, D.C., when he took his first job with the U.S. Department of Justice and was later transferred to the agency's Fort Worth office; over the years, he honed his legal skills while working for several law practices, including Winstead, McGuire, Sechrest and Trimble, LLC, of which he was a founding partner; he was also employed for a time as a partner in Centre Development, before becoming a cofounder of Catlyn Capital Corporation alongside his longtime friend, Baker Montgomery; and
WHEREAS, Mr. Trimble shared 44 rewarding years of marriage with his wife, the former Mary Mitchell; a longtime animal lover, she persuaded him to take on a pro bono case representing an animal rescue group, which proved to be the beginning of an exceptional career as a champion for animal welfare legislation; his advocacy played an instrumental role in the passage of a number of state laws, including the Safe Outdoor Dogs Act, as well as legislation regarding puppy mills, dog fighting, exotic animal ownership, and regulation of breeders, and he worked to prohibit the use of carbon monoxide for euthanasia; moreover, he contributed to the Dallas City Council's Humane Pet Store Ordinance and to the establishment of a local low-cost spay/neuter clinic; and
WHEREAS, Mr. Trimble served on the boards of the Texas Humane Legislative Network, the Metroplex Animal Coalition, and other organizations; he was also a former chair of the Dallas Animal Advisory Commission, and he was involved in the formation of the Animal Law Section of the State Bar of Texas and of the animal cruelty prosecutor position in the Dallas County District Attorney's Office; in addition, he was a valued member of Holy Covenant United Methodist Church; and
WHEREAS, Skip Trimble lived a life of profound devotion to his beloved family and to the causes he held dear, and he will forever be remembered with admiration and affection by those he has left behind; now, therefore, be it
RESOLVED, That the Senate of the 88th Texas Legislature hereby pay tribute to the memory of Robert Lynn Trimble and extend deepest sympathy to his loved ones; and, be it further
RESOLVED, That an official copy of this resolution be prepared for his family and that when the Texas Senate adjourns this day, it do so in memory of Skip Trimble.
