The Senate met at 10:25 a.m. pursuant to adjournment and was called to order by President Pro Tempore Birdwell.

Lord, I know the last time I had the honor of opening our session in prayer I used these same words, but they still ring true today. I am so thankful for Your amazing grace. The grace that brings us together on this day and in this hallowed place. Second Timothy says: For God has not given us a spirit of fear, but of power and of love and of a sound mind. Too often, we seem to govern from a place of fear. Help each of us remember, Lord, that You have given us a spirit of power, of love, and sound mind. Help us to remember You have delivered us from fear already. Today, let us pray to accept Your amazing grace and extend it to others. We pray to be guided by Your spirit of power, of love, and of sound mind to work toward a brighter future. We pray that we may spread Your light through our actions. Help us focus on those who are the most vulnerable in our communities. Lord, we pray for insight and wisdom. Renew in our hearts the hope, inspire in us the creativity, and instill in our minds the imagination that reminds us we can do great things in Your name, for the greatest good, for all of our fellowman. Bless our beloved state and the people who make Texas their home. We pray these things this morning, according to our faith, respecting and honoring all faiths. Amen.

SENATE RESOLUTION 268

Senator Miles offered the following resolution:

WHEREAS, Members of the Texas chapters of 100 Black Men of America are gathering for 100 Day at the State Capitol in Austin on April 22, 2021, and their visit offers a fitting opportunity to celebrate the work being done by this outstanding organization; and
WHEREAS, 100 Black Men of America was founded in New York City in 1963, when a group of visionary leaders in business, politics, and other fields came together to explore ways of improving the quality of life in the African American community; today, the organization numbers more than 105 chapters and over 10,000 members nationwide; guided by the motto "What They See Is What They'll Be," these accomplished individuals are presently enhancing the educational and economic opportunities available to more than 125,000 minority youth; and
WHEREAS, Based upon the four pillars of mentoring, education, health and wellness, and economic development, the organization's programs seek to address the emotional and cultural needs of African American children, to provide volunteer support to schools and educators, to advocate in behalf of equal access to education, to promote physical fitness and healthy eating habits, and to empower African American individuals and enterprises through training in financial literacy and networking; and
WHEREAS, Contributing to the advancement of this vital mission are the members of 100 Black Men of America who are active in the organization's Texas chapters, which represent Austin, Greater Beaumont, Greater Dallas/Fort Worth, Metropolitan Houston, San Antonio, and West Texas; and
WHEREAS, For nearly six decades, the members of 100 Black Men of America have helped to set countless young people on the path to a brighter future, and they are indeed deserving of commendation for their myriad good works; now, therefore, be it
RESOLVED, That the Senate of the 87th Texas Legislature hereby honor 100 Black Men of America for its long history of service to African American youth and extend to the visiting Texas members sincere best wishes for a meaningful and memorable stay in Austin; and, be it further

REMARKS ORDERED PRINTED

On motion of Senator Bettencourt and by unanimous consent, the remarks by Senator West regarding SB 2212 were ordered reduced to writing and printed in the Senate Journal as follows:

Mr. President and Members, at this time I would request to suspend the Senate regular order of business to take up Committee Substitute to Senate Bill 2212. And this is a bill that deals with an officer's duty to request and also to render aid. Members, there will be another bill by Senator Miles that also deals with police accountability issues today. And I'm glad to see the Senate, Mr. President, leading on this issue. Members, whether we sympathize, are angered by, or want them all to go away or ignore these topics of today related to criminal justice and police reform and social justice, we must acknowledge their presence and realize they are unlikely to move from public discourse anytime soon and that it takes our law enforcement and also members of the advocacy communities to work together to figure out exactly what can be agreed upon. Recognizing that the legislative process is one of compromise, I think that when we look at this particular issue, you'll recognize that it may not be everything that everyone wants, but it is, in fact, a step in the right direction. We can help to resolve issues by being active and developing policy solutions that are in the best interest of not only law enforcement but all of the constituents that make up the dynamic, growing, and diverse state. Policies should reflect that we are all in this together. Through our ongoing dialogue with legislative leaders and stakeholders during this session, Senate Bill 2212 was developed, and if passed into law, will illustrate the role of law enforcement as public servants. Mr. President, this particular bill requires an officer to immediately request emergency medical assistance for injured persons they encounter during the course of their official duties. It requires officers, to the extent possible, given their proficiency and training, to provide first aid or treatment for injured persons, codifies practices that are in place in many Texas law enforcement agencies, and protects officers saying that medical assistance is not required if doing so would place officers or others in a danger or dangerous or be in a situation where they would be injured. So, I at this time, I would request suspension of the regular order of business.

On motion of Senator Bettencourt and by unanimous consent, the remarks by Senator Miles regarding CSSB 68 were ordered reduced to writing and printed in the Senate Journal as follows:

Senator Miles:  Thank you, Mr. President. Thank you, Mr. President and Members. I don't think it's a secret that the 100 Black Men of Texas took today, the post-sentencing of Mr. Chauvin as relates to the George Floyd Act, that they would be here to hear these two bills by two Black Senators, the only two Black Senators in the State of Texas. But, Mr. President, I want to thank you and Members of this body. At this time, I'd like to suspend Senate regular order of business to take up, consider SB 68. The bill requires peace officers to intervene, to stop, or to prevent another police officer from using excess force under the circumstances. Members, my brothers, George Floyd may have been still alive today had this law been put in place, because when you looked at the film, there were numerous officers standing around but no one, not one of them thought to intervene with their fellow police officer. In the nine minutes that his neck was being pressed down on by his knee, not one of his officers made a move to remove him. So, in the State of Texas, after we pass this bill, and, brothers, I want you to know it's not just me passing a bill. Every elected body you see on this floor whether it be Black, Brown, or White, is passing this bill under great leadership. We thank you, Sir, Madam Chair, we thank you. But you should know the officer who witnessed this excessive force must submit a report of the incident to a supervisor. An officer must be interviewed separately, if he was on the scene, to see if there were other officers that witnessed this event, violating the law, putting someone's health or bodily harm at risk, using force not required to apprehend a suspect. Officers sometimes do not intervene when they witness misconduct because they may be fearful of retaliation from their fellow officers. And we understand that, but that's not acceptable. By peers, fear, and jeopardizing their career by interfering, officers sometime do not intervene when they're the witness. SB 68 addresses these by requiring an officer to interview, intervene in an excessive use of deadly force to benefit the person who's in custody. We all know what happened. We all know what took place. But I can assure you, my brothers, the leadership in this state, the leadership in this state is not going to stand by. Can I get a amen, Governor Patrick?

President:  You can get an amen because we've all worked on this together, 31 Senators and our office, and these are two good bills.

Senator Miles:  So, brothers, go home tonight knowing that you saw history. You saw history in Senator West's bill, and you're seeing history with this bill being passed, a great day for y'all. To this entire body, again, not just Senator West and I, but this entire body including leadership, we understand things need to be fixed. So, with that being said, Mr. President, I want to move for suspension.
