SENATE RESOLUTION 331
Senator Burton offered the following resolution:
WHEREAS, Many proud residents of Mansfield are visiting Austin to celebrate the distinctive attributes and achievements of their community during Mansfield Day at the State Capitol; and
WHEREAS, Located in the Cross Timbers country of North Central Texas, south of Arlington, the settlement was first established by pioneers in the 1840s; in the late 1850s, R. S. Man and Julian Feild built a gristmill in the area, at the crossroads that later became the center of the town, which was named for the two men; and
WHEREAS, Mr. Feild soon added a general store across the street from the mill and became the town's postmaster in 1860; during the Civil War, the Man and Feild gristmill supplied meal and flour to fighting soldiers, and it later did the same for those at United States Army outposts and Indian reservations in Texas and New Mexico; though incorporated in 1909, the town remained a farming community until the suburban expansion of the Dallas/Fort Worth area brought many new residents; and
WHEREAS, Today, the city's more than 60,000 residents can enjoy 240 acres of parks and a quality of life reflected in the town's inclusion on Money magazine's 2012 list of the top places to live in the United States; and
WHEREAS, Mansfield will be led in 2015 by the members of its city council, including Mayor David Cook and Mayor Pro Tempore Larry Broseh, as well as Brent Newsom, Stephen Lindsey, Darryl Haynes, Cory Hoffman, and Wendy Burgess; also committed to the town's well-being are members of the Mansfield Area Chamber of Commerce, including its executive committee, Rob Schulz, Bry Acker, Joanie Pace, Grant Hall, David Harris, Kevin Allee, Leigh Ann Tipping, and Dan Phillips, its other directors, Monty Goddard, Angel Biasatti, Michelle Canton, Jenny Conrad, Mike Leasor, Omar Pineda, Karen Tecklenburg, Katie Watson, Brendan Kelly, Louis J. SECTION ____. Section 46.035, Penal Code, is amended by amending Subsections (g), (h), and (j) and adding Subsections (a-1) and (l) to read as follows:
(a-1) Notwithstanding Subsection (a), a license holder commits an offense if the license holder carries a partially or wholly visible handgun, regardless of whether the handgun is holstered, on or about the license holder's person under the authority of Subchapter H, Chapter 411, Government Code, and intentionally or knowingly displays the handgun in plain view of another person:
(1) on the premises of an institution of higher education or private or independent institution of higher education; or
(2) on any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area of an institution of higher education or private or independent institution of higher education.
(g) An offense under Subsection (a), (a-1), (b), (c), (d), or (e) is a Class A misdemeanor, unless the offense is committed under Subsection (b)(1) or (b)(3), in which event the offense is a felony of the third degree.
(h) It is a defense to prosecution under Subsection (a) or (a-1) that the actor, at the time of the commission of the offense, displayed the handgun under circumstances in which the actor would have been justified in the use of force or deadly force under Chapter 9.
(j) Subsections (a), (a-1), and (b)(1) do not apply to a historical reenactment performed in compliance with the rules of the Texas Alcoholic Beverage Commission.
(l) Subsection (b)(2) does not apply on the premises where a collegiate sporting event is taking place if the actor was not given effective notice under Section 30.06.
SECTION ____. Section 46.035(f), Penal Code, is amended by adding Subdivision (1-a) to read as follows:
(1-a) "Institution of higher education" and "private or independent institution of higher education" have the meanings assigned by Section 61.003, Education Code.
(4) Renumber the SECTIONS of the bill accordingly.

(a-2) Notwithstanding Subsection (a) or Section 46.03(a), a license holder commits an offense if the license holder carries a handgun on the campus of a private or independent institution of higher education in this state that has established rules, regulations, or other provisions prohibiting license holders from carrying handguns pursuant to Section 411.2031(e), Government Code, or on the grounds or building on which an activity sponsored by such an institution is being conducted, or in a passenger transportation vehicle of such an institution, regardless of whether the handgun is concealed, provided the institution gives effective notice under Section 30.06
(g) An offense under Subsection (a), (a-2), (b), (c), (d), or (e) is a Class A misdemeanor, unless the offense is committed under Subsection (b)(1) or (b)(3), in which event the offense is a felony of the third degree.
(h) It is a defense to prosecution under Subsection (a) or (a-2) that the actor, at the time of the commission of the offense, displayed the handgun under circumstances in which the actor have been justified in the use of force or deadly force under Chapter 9.
(j) Subsections (a), (a-2), and (b)(1) do not apply to a historical reenactment performed in compliance with the rules of the Texas Alcoholic Beverage Commission.
(2) Renumber the SECTIONS of the bill accordingly.

The Texas Higher Education Coordinating Board shall issue a report of the study, with recommendations regarding reduction of the fiscal impact of this Act on institutions of higher education and private or independent institutions of higher education, for consideration by the 85th Legislature.

(18) "Gun show" means a place other than a permanent retail store, including a driveway, sidewalk or walkway, parking lot, or other parking area, or an event at which:
(A) three or more individuals assemble to display firearms or firearm components to the public; and
(B) a fee is charged for the privilege of displaying the firearms or firearm components or a fee is charged for admission to the area where the firearms or components are displayed.
(19) "Gun show promoter" means a person who organizes, plans, promotes, or operates a gun show.
SECTION ____. Chapter 46, Penal Code, is amended by adding Sections 46.065 and 46.066 to read as follows:
Sec. 46.065. CERTAIN REQUIREMENTS RELATING TO SALES AT GUN SHOWS. (a) A person commits an offense if the person knowingly sells a firearm to another person in exchange for money or other consideration at a gun show without complying with the national instant criminal background check system in the manner required by 18 U.S.C. Section 922 before completing the sale. A person who conducts a criminal background check as required by this subsection may charge a fee of not more than $10 to conduct the check.
(b) A person commits an offense if the person knowingly sells a firearm to another person in exchange for money or other consideration at a gun show and the person does not maintain a record of the sale.
(c) It is an exception to the application of Subsection (a) that the person to whom the firearm is sold:
(1) is licensed to carry a concealed handgun under Subchapter H, Chapter 411, Government Code; or
(2) is a peace officer.
(d) An offense under Subsection (a) or (b) is a Class A misdemeanor.
Sec. 46.066. CERTAIN REQUIREMENTS RELATING TO GUN SHOW PROMOTER. (a) A gun show promoter commits an offense if the promoter, with criminal negligence, permits the sale of a firearm to a person at a gun show organized, planned, promoted, or operated by the promoter without complying with the national instant criminal background check system in the manner required by 18 U.S.C. Section 922 before completion of the sale.
(b) It is an exception to the application of Subsection (a) that the person to whom the firearm is sold:
(1) is licensed to carry a concealed handgun under Subchapter H, Chapter 411, Government Code; or
(2) is a peace officer.
(c) Not later than the 30th day before the date on which a gun show is held, the gun show promoter shall provide written notice of the date, time, and place of the gun show to the local law enforcement agency of the county or, if applicable, the municipality in which the gun show will be held.
(d) A gun show promoter shall conduct, or arrange for a person who is a licensed firearms dealer under 18 U.S.C. Section 923 to conduct, an instant criminal background check in the manner required by 18 U.S.C. Section 922 on any person who purchases a firearm at a gun show organized, planned, promoted, or operated by the promoter from another person who is not a licensed firearms dealer under 18 U.S.C. Section 923. A person who conducts a criminal background check as required by this subsection may charge a fee of not more than $10 to conduct the check.
(e) A gun show promoter shall prominently post a notice in a form prescribed by the Department of Public Safety stating the requirements under this section and Section 46.065 relating to an instant criminal background check.
(f) A gun show promoter commits an offense if the promoter violates Subsection (c), (d), or (e).
(g) An offense under Subsection (a) or (f) is a Class A misdemeanor.
(h) If conduct constituting an offense under this section also constitutes an offense under Section 46.065, the actor may be prosecuted under either section or under both sections.
SECTION ____. The change in law made by Section 46.066(c), Penal Code, as added by this Act, applies only to a gun show held on or after October 1, 2015.
